Im concerned that I may have to sign a prenuptial agreement. However I know very little about them. Can you give me some information that would help?

Hi Angie,

I can give you some general information, but you really need to talk with a lawyer or check out some of the legal sites on the Internet, such as Findlaw.com or Nolo.com. Basically, a pre-nuptual agreement is a legally binding contract that is written to protect the interests of both parties should the marriage end in divorce. The agreement must reflect the laws of the state in which you reside. Things to consider are how property that you each bring into the marriage will be treated, how property jointly obtained during the marriage will be divided, how bank accounts will be set up and how bills are to be paid, and arrangements for the care and support of future children. Each couple has unique circumstances that should be considered. Be sure that you have some input into the drafting of the document, preferably from a lawyer, and don't sign it unless you fully understand it and are in agreement with all of the provisions. You don't want to be unpleasantly surprised one day in the distant future.

This is something that you need to talk to an attorney about. If a legal marriage occurred and the marriage license was recorded with the state (the minister or judge who performed the ceremony does this), then the marriage is legal.

The wording of the couple's prenuptial agreement will govern how their assets are treated. It is possible that a couple could state in their agreement that if the marriage ends in the first six months, their individual assets will not be affected, but an attorney would need to interpret the agreement.

If you are thinking that ALL prenuptial agreements say that a marriage that ends within 6 months does not affect their assets, I don't believe that is the case.
